Unfinished Business

      Now that Trump and his "Elite Legal Team" is in place, is there any wonder their record is now 1-29, and that one "victory" didn't really change anything that wasn't already being done.  With Rudy Guiliani making himself the poster child of the Trump team, is there anything else that needs to be added? I mean, telling the public about rampant fraud while telling judges at every level in every state they have no evidence of fraud, smacks a tad bit like a ride on the "Crazy Train" doesn't it?
     If you read any of the pleadings submitted by the Trump team, you would soon realize that they are all perfect examples for future lawyers learning about the use of Summary Judgment.  Summary Judgment is utilized when there are no actual facts in dispute and the ultimate remedy is already in hand.  In these cases, a simple Motion to Dismiss has worked quite well, but Summary Judgment probably would also apply (if Trump's team could at least meet the minimum threshold of presenting any credible evidence of fraud - which they not only have not, but also cannot - there is no such evidence).
       One would not have to be a law student or a lawyer to recognize Trump and the GOP are using the "Litigation" strategy not to prove anything in courts of law, but instead in courts of public opinion.   And by doing so, Trump has convinced his cult that not only did he win the election, but that Biden "rigged" it all along.  I thought Biden was "Sleepy Joe hiding from his basement?"  That's quite a lot of rigging to win 306 electoral votes along with almost 80 million in the popular vote totals.  And Trump wants us all to believe he really won and that Biden did not score a landslide?  For those with short memories, Donald Trump LOST the popular vote to Hillary Clinton in 2016 by 3 Million votes, yet he, the GOP and their Right Wing Media mouthpieces amplified his proclaimed "Landslide Victory".  If LOSING 3 million votes while attaining 306 Electoral Votes warrants the label "Landslide", what does one need to call winning the popular vote by about 6 Million AND the Electoral College with 306?  I guess landslide would then apply right(Unless you are a MAGA/GOP'er)?  The hypocrisy has no bounds.
        Perhaps more dangerous is the refusal of Trump to concede he lost.  Not only is he wrongfully interfering with the peaceful transition of power in the Executive Branch, he and his enablers are using the delays caused by the incessant and frivolous lawsuits in order to convince his followers that the election was in fact "rigged."  By doing so, Trump hopes GOP state legislators will defy the votes of the people and impose their own Trump Electors to ensure he serves an additional four year term.  The Framers of the Constitution  never imagined that elected officials would defy the popular vote and recklessly cast open and fair elections to the winds in favor of securing the presidency through such authoritative measures.  But that is exactly what Trump and his team have been trying to do.  Just today we learned that Trump himself pressured two GOP country canvassing board members in Michigan to oppose certifying the votes in Detroit.  Why?  SO they could have a scintilla of a claim that the election was "fraudulent" and therefore, is subject to intervention by the GOP Legislature.  All of this is happening while the GOP remains silent.  They claim they want to wait until litigation is complete, except after losing 29 times in State and Federal Courts, there has to be another reason for their reluctance.  Could they really be counting on the "Plan B" strategy of overturning the election results by GOP electoral action?  
       Back in 1787, Daniel Shay led a rebellion against Post-Revolutionary War "foreclosure laws" in the state of Massachusetts.  Halfway through the rebellion, Captain Shays convinced his men that America was not England, and that laws can be changed by winning elections in legislatures.  By electing favorable leaders, the laws they detested could be stricken or rewritten.  There was no need for additional violence.  In other words, America was different because political change comes via elections and not at the "tip of the gun."  With any notion by Trump and the GOP that they can unilaterally ignore the will of the people by simply claiming fraud when there is none, can one expect our democracy to survive?  If elections no longer mean anything, when the losing party can use authority to overturn a loss into a victory, perhaps democracy in America has a chance of being ended - by authoritative desires residing squarely in hearts and minds of Trump, MAGA and the GOP?
     All the while, two Senate races remain undecided in the State of Georgia.   A run-off election is slated for January 5, 2021. In the event the Democrats win both races, there will be tie in the United States Senate.  In the event of a tie and upon inauguration, the Vice-President Elect will have the ability to break all ties.  Hence, the Senate will fall under a Democratic majority and Mitch McConnell and his GOP sycophants can now be seated in the "back row" where they have kept the Democrats since 2012. Only then can measures be undertaken to ensure we never have this kind of nonsense from our sitting President or his spineless GOP party. 
     So please, strongly support Warnock and Ossoff in their efforts to swing the Senate Blue - for America.  There's still unfinished business here in America.
